TERRI SCHIAVO IS EACH OF US
SENTENCED TO DIE AS USELESS

Don't even consider the idea that Terri Schiavo's case is either unique or particular to her family in this Machiavellian age. It is neither. An individual ordered by a court, sentenced to death by starvation because she is "a useless feeder" is each and every one of us under similar circumstances, a human over whom the state has exercised the power of life and death absent any crime and punishment being involved. The punishment is for being useless, a burden to the state, considered a soulless offspring of the detestable theory of evolution that renders all of us just an accident in primordial slime.

She is me because I am disabled with a spinal fracture. She is every maimed and "useless" veteran of the wars in which America has involved itself for political reasons and left behind the unnamed military personnel, some teenagers, whose lives will be spent as disabled persons requiring continual medical care. She is each elderly person whose life has been spent going to school, getting married, having children, being a productive worker for the government's tax program and a contributor to Social Security. She is you and me and all of these people who were disabled by an accident at work, at home, in an automobile.

She is an American who was once an able-bodied person welcomed by the gods of the state. Now she has been sentenced to die as a useless feeder.

We don't have miracles any more, and this nation surely has spit in the face of God with its disregard for the sanctity of life. Sanctity of life, permanence of marriage and stability of the home belonged to some ancient age from around 1970 and prior when we had values and didn't need to broadcast it for reassurance that the lie will stick. Values indeed. If there is any value higher than that of the sanctity of life and the sovereign will of God, then even God has not made that proclamation!

America is utilitarian now, or Hegelian, or anything the government wants to brand it.

We're anything except free. We aren't human, we have no soul, and the state owns us and the children of those who are parents. Then people write and ask, "how do you figure we're not free?" Duh.

The leadership and the high courts of this nation have brought upon it the beginning of the judgment of Almighty God and the intensity of that judgment will increase with every wrong this nation perpetrates upon its own citizens and those in other sovereign nations under a translucent veil of "spreading freedom."

Beware of following the philosophy of a government that has no respect for life or belief in God. Those are elements in the statement of faith of our forefathers who built this nation. Even the atheists of their time weren't as crass as the "egalitarian" leadership of today, wicked judges and pretenders to the throne of God who will perish with their hubris.

A generation of liars in high places will bring the nation and its people to ruin, history sets its seal to that thesis.

Think about this, prospective parents, Social Security recipients, those with parents in nursing homes, and those in hazardous occupations (including driving a motor vehicle in expressway traffic): will the state take a newborn with Down's Syndrome and give it a lethal injection? Will those who paid for Social Security "insurance" stolen by the government for foreign war meddling be "vaccinated" with a lethal fluid? Will your parents suddenly have a stroke and then die while you are at work, or in the middle of the night? I received a call in the middle of the night that my mother had a second stroke, but was never apprised of the first. I was injured at work and discharged by a doctor on friendly terms with my employer as "medically stable with no permanent impairment" when I had two spinal fractures.

It can happen to anyone, yes it can happen to you, and the anyones and you and I no longer have any say in our "representative" government. Ask the people on the street if they feel adequately represented. Look at the articles, the statistics, you will find that the people want one thing and the government wants another. Guess who wins?

Terri Schiavo is one individual, a living soul who is about to suffer death by starvation at the mandate of the court of "justice" as it is now interpreted in this godless land. If our military starved an enemy captive to death there would be an international uproar and courts martial. But a helpless woman whose husband wishes to remarry? A burden to the state? Not a problem for the judges to order such a person to die.

But remember, she is not just one individual.

She is all of us, each of us, one of us.

Her judgment and sentence is ours also.

There is but one judgment for perverse judges and evildoers to fear, and that is the final judgment of God, when true justice is revealed against all unrighteousness, in this land and around the world.

We have that on infallible Authority from the Judge Himself. Amen!

If everyone remembers the O. J. Simpson case, the prosecutors were unable to get a conviction for criminal charges, because the jury was not convinced beyond a reasonable doubt, but he was found guilty of wrongful death (murder) in a civil lawsuit by the parents. It cost him a fortune to fight in these cases and his reputation is still ruined. No doubt he has nightmares and ongoing psychological problems, recurring bills for therapy, etc. as will Michael Schiavo. It will never end, and never get better for Michael Schiavo - only worse. He thinks he has problems now?

The standard of proof in civil suits is lower and needs to be proven only by a preponderance of evidence. Plus all the proceedings so far have been before one very biased man, Judge Greer. The outcome will be very different when this case is presented before a jury.

There are numerous red flag issues here that will be fodder for civil lawsuits for many years to come.

The Schindler family can file a civil lawsuit against Michael Schiavo for wrongful death, the doctors, involved for malpractice, Judge Greer for malfeasance, and the state of Florida (Department of Children and Families) for failure to protect the life of a disabled person, including doctors who examined Terri and found her condition of rigid neck, and then the injuries shown on the bone scan. They did not notify authorities of a "possible" abuse situation. This is malpractice.

These lawsuits will give them access to all records and documentation. A private investigator can be hired (if one is not already working on this) to search for witnesses (such as neighbors, friends, hospital workers or coworkers) that could provide testimony regarding any prior abuse situations. The investigator also will find proof of collusion and conspiracy between certain doctors who claimed Terri is in a PVS, the hospice, George Felos and Judge Greer. If proof is covered up, if records are destroyed, these will come out. If there is a link showing Judge Greer was prejudiced and had conflicts of interest that should have made him recuse himself, then he liable. He will be removed from the bench.


All will come out. These are the times for ultimate exposure. It will never, ever end and never, ever get better for Michael Schiavo in any way - only worse. His problems are just beginning. Just wait - It will be a very interesting show.

Associated Press Targets Terri Schiavo

Media repeats misrepresentations in Terri Schiavo case.

Clearwater, FL – On February 24, 2005, Associated Press released a report penned by Vickie Chachere which cited an eating disorder as the cause of Terri Schiavo’s mysterious collapse and ensuing brain injury on February 25, 1990.

Contrary to the account of writer Chachere, there was never a determination by any court nor the Florida Department of Health that Terri Schiavo ever suffered from any eating disorder, bulimia, anorexia or compulsive behavior that would lead to a heart failure at the age of 26.

Indeed, Florida’s Department of Health had completely and absolutely cleared Terri’s general practitioner of any negligence or wrong-doing in her case. This was after the physician had been accused by Terri’s husband of ignoring evidence of an eating disorder.

Additionally, at the time of her mysterious medical episode, Terri Schiavo stood 5’3” and weighed somewhere between 115 and 118 pounds – a slim, but normal stature and weight.

Associated Press writer, Vickie Chachere cites not ONE medical document that would affirm her careless contention that Terri Schiavo was an irresponsible dieter or a compulsive victim of an eating disorder. The Terri Schindler-Schiavo Foundation asks Ms. Chachere to readily produce the facts upon which she penned such assertions.

The parents and siblings have repeatedly offered to media and press a copy of a bone scan conducted on Terri Schiavo just one year after her incident that reveals multiple sites of trauma and broken bones throughout Terri’s body. Neither the law enforcement agencies nor the media or press have made any effort to investigate why Terri Schiavo’s body was seemingly broken by battery.

Instead, they perpetuate the unsubstantiated claims that Terri Schiavo suffered from an eating disorder that rendered her healthy, 26 year-old heart incapable of carrying on.

Statement of Robert Schindler, Terri’s’ Father: “"This is a slanderous accusation against my daughter with no basis in fact. Certain members of the press seem determined to spread misinformation to kill Terri."

The Terri Schindler-Schiavo Foundation is calling upon all of media and press to take up the task of investigating allegations of serious abuse against Terri Schiavo as are evidenced in the 1991 bone scan and well as ongoing violations against Terri under Florida’s Guardianship Statutes.

Florida Supreme Court splits 4-3 on surprise last-minute filing in Terri Schiavo Case While many parties have become involved in the Terri Schiavo case, there has been much activity under the radar, not reported by the mainstream press.

LAKELAND, FL (The Register) Friday, 25 February 2005 - Terri Schiavo supporters have been bolstered by a surprise, last-minute filing from an unexpected source. Lakeland, Florida resident, Gordon Watts, who filed a petition for writ of Habeas Corpus with Florida’s high court on behalf of Schiavo in late November of 2003, shortly after Schiavo’s feeding tube was removed and re-inserted, has struggled against powerful interests who have attempted to discredit and dismiss his involvement in this high-profile case. Watts also has experience in the U.S. Supreme Court, which is expected to hear his racial profiling case today, and can be found at the court’s official website: http://www.supremecourtus.gov/docket/04-8132.htm regarding a situation in which he was asked to leave an establishment based allegedly on his minority ethnic background.

In spite of much opposition and ridicule from mainstream media and other parties, however, Watts’ case has remained alive in Florida’s Supreme Court for over a year until this past Wednesday.

Watts, who learned of the Schiavo case in 2003 from news reports, immediately moved to file as “next friend” to challenge Schiavo’s alleged illegal detention in hospices, which, according to State Law, are only allowed to admit terminal patients, which are expected to die within six or fewer months. Watts’ filings bear many similarities to filings made by the immediate family, but have additional elements, such as the direct challenge to the placement of Schiavo in a hospice facility and the use of the writ of habeas corpus. Watts has said that the immediate family would be more appropriate to file, but seeing no one else make these legal arguments, petitioned the court, noting that he need not be “closest friend” to satisfy legal Due Process requirements for the handicapped woman, who has been denied legal representation for much of her ordeal.

Mr. Watts also took issue with the fact that court orders only spoke to the feeding tube, but that parties removed both the feeding tube and also denied natural food, the latter a felony under chapter 825 state laws.

Due to the recent developments, many parties have asked Watts to request that the high court issue a stay on the probate court proceedings while the Supreme Court justices have a chance to review his petitions on an expedited basis. This past Tuesday, Watts requested the court review his legal arguments, and late Thursday, it was learned that the court had quickly moved the previous day to issue a decision. Justices voted 4-3 to uphold a previous tentative decision to dismiss the filing based on technical errors.

Voting to dismiss, without a written opinion, were Justices Kenneth Bell, Raoul Cantero, Peggy Quince, and Charles Wells. Voting to allow Watts to continue to file on behalf of Schiavo were Justices Harry Lee Anstead, R. Fred Lewis, and Chief Justice Barbara Pariente. Responding to claims that he does not have legal right to challenge Schiavo’s detention in the hospice network, Watts declares that “non-lawyers” may intervene in rare instances and quotes “The Operation and Jurisdiction of the Florida Supreme Court” by Gerald Kogan and Robert Craig Waters, the court’s current spokesperson (18 Nova L. Rev. 1151, at 624., Fla. 1994), which states that “Even detention imposed on someone by a private individual potentially can be tested by habeas corpus. The most common use is where one parent alleges that the other parent has taken custody of a child wrongfully.” Mr. Watts also cites other landmark cases to support his claim that he may intervene: State ex rel. Deeb v. Fabisinski, 111 Fla. 454; and, the U.S. Supreme Court’s holding in Whitmore v. Arkansas, 495 U.S. 149, which held that that to be a ‘next friend,’ one need only “provide an adequate explanation--such as inaccessibility, mental incompetence, or other disability--why the real party in interest cannot appear on his own behalf.”

Some in the news media have made issue with the fact that Watts has filed other cases and labeled him as a “frivolous lawsuit” filer. Watts responds: “When, in the court of public opinion, a news writer wants to write multiple articles and deny me any coverage, I do not call him a ‘frivolous news article’ writer, and likewise, when I find several injustices, I would like to have my right to get a fair day in court to have our freedoms protected in this country of declining morals. Therefore, with everyone distracted by ‘Terri’s Law’, I think it right for me to try to help Theresa Schiavo, the person.”

Watts, a Biology and Chemical Science honor student and alumni from The Florida State University, hopes that the combined efforts of many people can prevent the danger of placement in medical facilities in which they are prohibited by law.

After being narrowly denied at Florida’s High Court, Watts plans to appeal to the United State Supreme Court and ask the nation’s highest court for permission to directly intervene on behalf of Terri Schiavo.

Felos has reportedly received over $550,000, which has elicited charges that he is perpetuating the case for financial gain. According to the last accounting made public, for the period of March, 1998 when he was first hired until September, 2001, Felos was reportedly paid $307,188. Former attorney Deborah Bushnell was paid $49,958 and there were four other attorneys, two presenting Michael Schiavo and two court-appointed attorneys in the matter. Just called Bush's office and the Head of the Florida Assembly. Bush's office would not take my name, when I asked if she was writing this down, she said "No, I'm not we will pass your coments on to the Govenor."

Now in the President of the Senate there they took my name and address and were very impressed that I was calling from France. She wrote everything down! Told her how bad it looks to see President Bush in Europe then the next story is how his brother in the State of Florida is letting a disabled woman be starved to death. The woman said that I was the first aller from France. She kept insisting that I tell here where I lived in the states, finally she figured out that I don't live in the States that really, I was calling form France. The woman in the Assembly Presidents office said very sincerely that they are doing everything they can to help Terri. She seemed sincere. When she answered the phone she asked to put me on hold and I asked her to come back quick since I was calling form France. She said she would try but that all the lines were lit up. So I sincerely echo Floridah Voter, PC93 and others, Call, call, and call again. E-mail is good but with phone calls they have to answer the phone, so iMHO a phone call is better. There were at least 2 people and I think 3 people manning the phones because she asked her co-worker to take a line because the woman was going on and on. I smiled at that one? I was wondering which one of my Freeper friends was on the other line :)) going "on and on"

I just called Mr. Hatches office. I had to call twice because I forgot to mention some things. There might be possible federal investigation but it is unknown because they weren't being very forthcoming. I left my name the second time. First time said about her being held in Hospice of the Florida Suncoast, Inc. for 5 years. She's not terminal and that she is on Medicaid. Second time to give my name and say Hospice is violating Americans with Disabilities Act in which expressly prohibits denying a substantially disabled patient in the United States of America nor permitting the authorization of any representative or Guardian of an individual with a disability “to decline food, water, medical treatment, or medical services for that individual” There was a different person the second time.. said he would relay it to the Senator but that he had to go.. basically cut me off so I couldn't read the Section numbers of the Code itself. (Title 42, U.S.C. Sections 12101 and Cf 28 CRF, Ch 1, Subpart B, Section 35.130).

Felos has reportedly received over $550,000, which has elicited charges that he is perpetuating the case for financial gain. According to the last accounting made public, for the period of March, 1998 when he was first hired until September, 2001, Felos was reportedly paid $307,188. Former attorney Deborah Bushnell was paid $49,958 and there were four other attorneys, two presenting Michael Schiavo and two court-appointed attorneys in the matter. According to the last accounting made public, until Sept. 2001, Felos had been paid $307,188 and he's now claiming he received less than $50,000 for the last four years???? Just called Bush's office and the Head of the Florida Assembly. Bush's office would not take my name, when I asked if she was writing this down, she said "No, I'm not we will pass your coments on to the Govenor."

Now in the President of the Senate there they took my name and address and were very impressed that I was calling from France. She wrote everything down! Told her how bad it looks to see President Bush in Europe then the next story is how his brother in the State of Florida is letting a disabled woman be starved to death. The woman said that I was the first aller from France. She kept insisting that I tell here where I lived in the states, finally she figured out that I don't live in the States that really, I was calling form France. The woman in the Assembly Presidents office said very sincerely that they are doing everything they can to help Terri. She seemed sincere. When she answered the phone she asked to put me on hold and I asked her to come back quick since I was calling form France. She said she would try but that all the lines were lit up. So I sincerely echo Floridah Voter, PC93 and others, Call, call, and call again. E-mail is good but with phone calls they have to answer the phone, so iMHO a phone call is better. There were at least 2 people and I think 3 people manning the phones because she asked her co-worker to take a line because the woman was going on and on. I smiled at that one? Surprise last minute filing in the Terri Schiavo case

TALLAHASEE, FL-There is a surprising last minute filing in the Theresa Schindler-Schiavo case from an unexpected source.

The Florida Governor and other parties while they have not done everything to the public’s satisfaction in regards to saving a disabled, purposely-denied-from-rehabilitation human life they have contributed somewhat and have introduced some delays which may prove useful in giving other parties enough time to go before the courts as well as the public opinion.

Now that this matter is coming right down to the wire other parties such as Mr. Gordon Watts have come before the courts. Although, there are some perhaps who think that Mr. Watts doesn't have a right to come before the courts so far they have been proved wrong because it is the courts that have allowed Watts' filing to remain alive since October 2003. Even as the Governor's spirited case has been dismissed and denied by the courts thereby denying due process at all levels in efforts to bring to light all the facts, Mr. Watts has now made a last minute filing which may prove to be one of Theresa’s saving graces.

On the parents’ side the Gibbs law firm has just recently made arguments to the court that Theresa Schindler-Schiavo has been denied representation in court. However, Mr. Watts made similar arguments several years ago and so is continuing to petition the courts along said lines. Seeing that Theresa’s life has been put into immediate jeopardy (in regards to the threat of Judge Greer possibly lifting a 5PM stay today that prevents removal of her feeding device which provides food and fluids into the GI tract by simple gravity flow), Mr. Watts has made a last minute filing which it is hoped will save Theresa from the threat of being heinously and barbarically killed via dehydration/starvation. Let it be noted that it would be illegal to starve and dehydrate an animal let alone a serial killer on death row and that the whole nation would be up in arms if anyone threatened to do this to a pig or said human. To say that subjecting Theresa to starvation/dehydration violates state, federal and international laws would be an understatement. What is happening here in Florida is morally, ethically, and philosophically reprehensible and violates all standards of decency in regards to human rights and a civilized society.

Although the family’s attorneys and the Florida Governor have made some good legal arguments only Mr. Watts has petitioned the court concerning Theresa’s illegal detention at the Hospice of the Florida Suncoast, Inc. based on the fact that she is not terminally ill and it is illegal according to state and federal laws for her to be placed into and detained in hospice. Mr. Watts has used habeas corpus as the vehicle to bring this argument. As it stands Theresa has been illegally detained at Hospice Woodside for close to 5 years.

Those who have done research on the internet have found that the Hospice of the Florida Suncoast, Inc. and a bioethicist / end-of-life / right-to-die network (Partnership for End-of-Life Care) from University of Miami headed by Ken Goodman and others from Nova Southeastern University Shepard Broad Law Center (Kathy Cerminara and Michael Masinter, so-called disability, right-to-die, advocates with connections to the ACLU) has firmly entrenched itself with the Florida Office of Elder Affairs, the recently scandal-ridden Department of Health, and on up to the Department of Veterans Affairs. University of Miami ethics head Ken Goodman did a national interview on PBS in November of 2003 in which he said that Theresa Schiavo was permanently unconscious for over 13 years and had no brain. The evidence shown in videos on national television news networks and across the internet as well as regular in-person visits by Terri’s parents, siblings, their attorneys and priests prove otherwise. To their shame the judges and governor have failed to meet with Theresa. There is also evidence that Michael Schiavo suppressed a bone scan in which he may be responsible for 13 fractures sustained by Theresa Schiavo which included a broken femur and a broken back which dated to the time of the “incident” which occurred on February 25, 1990. Michael became aware of this X-Ray bone scan which was performed on Theresa in March of 1991 for a closed head injury yet he failed to bring in the authorities. Any other person would have gone ballistic upon finding out the results of such a bone scan. This implicates Michael Schiavo as having some sort of culpability for Theresa’s original “accident”.

On another note, outside of the court arena, there is a growing effort by persons coming from many and various backgrounds in the realm of internet blogs which has grown to over 150 blogs seeking to providing factual information in this case which the mainstream media refuses to address or which the mainstream media continuously misrepresents. Another notable internet site called FreeRepublic.com also has been at the forefront of efforts by others to get justice for Theresa Schindler-Schiavo since at least August of 2003 and has served as another meeting place for people of diverse backgrounds and beliefs to meet, exchange information and coordinate efforts to wake up not only the mainstream press but to also bring wider attention in the public domain to her plight and the plight of other disabled and vulnerable people. A few notable internet news sites which have been especially good at getting factual information out in regards to Theresa’s plight are http://worldnetdaily.com and the up-and-coming http://www.theempirejournal.com from New York. In conclusion it is hoped that the combined team efforts of many parties will bear fruit and ultimately get justice for the disabled and vulnerable of the State of Florida and our nation, including Theresa Schindler-Schiavo. This is a call for all media outlets and people of great humanity who care to help avert Theresa’s murder, to demand that she be given protective custody and that the perpetrators who have been attempting her murder be investigated. The Florida Governor is the Chief Law Enforcement Officer of the State of Florida as well as the head of Department and Children and Families and he needs to bring the abuse of Theresa to a halt. Others are calling for the intervention of the President and the Pope.

I'm still of the opinion that your earlier suggestion to prevent self-murder may be one of the likelier-to-succeed options. By Florida law it is absolutely illegal. We can only hope that it will be possible to get Jeb Bush off the dime and protect Terri by executive order. [1] Greer has already approved HINO's request to immediately cremate Terri upon her death. Again, this pertains to her religious beliefs, because the Catholic faith totally disapproves of cremation.

[2] While police and state attorney assert that statute of limitation has expired on Attempted Murder which is really not the issue, a look at the other side of the coin in that assertion is presumption that THEY AGREE that possible attempted murder took place or at least there were efforts to make her dead. YIKES!

The point is, and one that either they consciously are avoiding or just simply (not likely) miss here, is that the 13 fractures coming to be known in March 1991 by "caregiver's" including the guardian appointed by the State of Florida, WHICH WERE NEWLY DISCOVERED INJURIES TO THE WARD at that point, is PROBABLE CAUSE ENOUGH as indicated by NY State Police Forensic Pathologist Expert, Dr. Michael Baden, and reported on NATIONAL AND GLOBAL TELEVISION in late 2003, to reopen the still unfinished and not thoroughly investigated "suspicious circumstances" of SPPD incident/call/case number 90-024846 and most certainly based on the inappropriate actions of the facility, guardian, and husband that resulted in NO TREATMENT of the 13 fractures (NEGLECT, ABUSE) and the Negligent decision to commit her to long term care nursing home with no therapy, and an active blockade of the therapy prescribed and/or suggested by medical professionals to prevent further injury and/or to correct and effect increase of capacity (DENIAL OF RETAINED RIGHTS and further FELONY NEGLECT FS825 is more probable cause and evidence that warrants full investigation as to the EXACT CAUSE of the fractures, full and exact reason the guardian did not treat the fractures (FELONY DENIED TREATMENT) and then instead pursued a course of documented and apparent continued NEGLECT to this day, through denial of anything that would attempt to increase her capacity, which is further violation of duties of guardian, is neglect of the ward and the disabled person and is Felony Crime and on and on.....ALL IS MORE THAN ENOUGH PROBABLE CAUSE TO WARRANT PROTECTION AND FULL LAW ENFORCEMENT INVESTIGATION whether SPPD, FDLE, FBI, PPPD, SAO, PCSO, US DOJ, they should go ask the expert pathologist from NY State Police, Dr. Michael Baden.

Nothing that I know of says you cannot reopen a case in which new evidence shines a light on what happened when they were allegedly alone February 25, 1990 and she came up injured (March1991 bone scan with extenuating circumstances appearing to be tied to inappropriate actions that have resulted in further harm and appears to be starting point of no further corrective aid to ward/patient/person).

Or at least open a new case that is based on Neglect by the caregiver/guardian to treat the 13 fractures and instead ignore and or hide the fractures thereby allowing a condition to prevent capacity increase due to the untreated fractures.

[3] The court has decreed that the oral musings of Terri as advanced by THE GUARDIAN in petitioning the court are Her Wishes To Be A Dead Person.

When anyone wishes to be a dead person and takes actions or omissions to accomplish that goal that is considered to be efforts by that person to commit an act which is prohibited by Criminal Law -- FS782 Self-Murder or Assisting Self-Murder by same law.

When anyone who wishes to be a dead person (as the court found Terri to be a person with such wish) is unable to make themselves dead on their own and/or are ASSISTED by anyone person or persons with becoming the dead person that they "wished" to become, then this is the commission of an act that is prohibited by Criminal Law FS782 and is the Felony Crime of Assisting Self-Murder.

The day that any attorney is able to get anyone with the authority to stop this CRIME that is currently in the commission of being attempted every minute of every day by this case being open and this order of this Judge NOT being voided, is the day that Terri Schiavo will be stopped from being assisted from killing herself -- being dead is that which these slime balls keep saying is what she wanted. She is prohibited from killing herself and EVERYONE on the planet is prohibited from helping her -- if these really were her wishes as this court has found. Even the Supreme Court of Florida has said that No One Can Change That fact found by clear and convincing evidence of the Judge Greer Trial Court.

It is simple. It has always been simple. And the system cannot handle simple.

But the public can and should shout this to the heavens.

Michael says she wants herself to be a dead person.

Case Over. Attempt to assist deathmaking over! Criminal arrests and prosecution needs to begin! The public awaits justice for Terri.

This is one of many "case over" points that have been advanced from the keyboard of David Kirkland. Many other keyboards have presented "case over" points as well.

Unfortunately, no attorney to date has figured out how to advance the prohibition of "Attempt to Assist Self-Murder" argument [FACT] but fortunately it is one that became blatantly evident to me at first reading of the public guardianship file when I first was "moved" to be interested in the "situation" May 1st of 2001. Records of my communications and notes taken all the way back to then continue to find this to be a key element. There are many others too, but this one is louder than most.

[4] When the Judge ordered no feeding by the tube in her abdomen any longer, that tube was removed on October 15, 2003. His order was satisfied; cased closed.

Florida Statute, ADA and UN Human Rights Law says that NO ONE can deny nutrition intentionally from a vulnerable, disabled person. Florida Law prohibits this as a 1st Degree Felony Crime punishable by 30 years to life imprisonment.

The guardian and everyone is bound by criminal prohibition to find every possible way to increase capacity of the ward and to provide sufficient nutrition as to protect the disabled ward and permit the continuance of life.

Given that the Judge, Judiciary, facility and Michael et al (caregivers) chose to abandon Terri Schiavo as if in a ditch in front of Hospice by deciding to not feed by tube method, the entire citizenry of Florida, the nation and the world should have been able to provide assistance to her so that she would receive nutrition and not perish.

But the entire world was CRIMINALLY prevented from aiding this abandoned person by the ring of law enforcement around her that stood watching her first suffer, second now aiding in her act of self-murder as sanctioned to be her wishes by Judge Greer and thirdly to NOT AID her in getting nutrition and removing her from the ditch and getting her protection as she was a very vulnerable person, now that she has been completely abandoned by the husband, the guardian and the judicial branch of the State of Florida.

The Pinellas Park Police certainly appear complicit of soliciting and participating in the Attempted Assisting of Self-Murder as well and they threaten us that they are going to arrest us for filing a false report when we try to apprise them of these crimes.

So too is the Department of Children and Families (DCF) complicit by first not causing law enforcement to protect her from 1) killing herself and 2) from refusing to initiate protective actions especially when all these crimes and activities to facilitate her being made to Die or allowed to take her own life have been repeatedly brought to this agency's attention by many persons. Especially, when evidenced in the complaint(s) of November 2001 and the subsequent 60 day investigation which appears to have been sabotaged by DCF itself, local law enforcement, the State Attorney’s Office and maybe by DCF Oversight Commission’s ball-drop of August 2002.

All we ask is for action now to stop this victimization of Terri Schiavo and get on with the business of giving her protection, the initiation of investigations and criminal prosecution of those who have actively sought and participated in this seemingly created by discussion and intent, premeditated attempt to cause Terri to die as evidenced in guardianship file attorney fee petition statements of Attorney Deborah A. Bushnell and George J. Felos, all prior to Michael Schiavo ever advancing Terri's alleged but affirmed by Judge Greer, wishes to be a dead person -- well after Michael's announcement of plans to marry his "fiancée" Jodi Centonze in Bucks County, Pennsylvania newspaper obituary of July 2, 1997 for Carol Schiavo, with no mention of Terri his wife as survivor. Too much confidence in making Terri a dead person and more probable cause to investigate his neglect since time of not treating the 13 bone fractures, thus all being supportive of keeping the WITNESS -- Theresa Schiavo -- from recovering any ability to be able to communicate what happened to her February 25, 1990 is even more probable cause to investigate what has been apparently perpetrated against her, thus showing that she remains a VICTIM without any finding of what REALLY HAPPENED TO her. It is way past time for Theresa to be put into protective custody, for investigations to be initiated and for prosecution of the perpetrators, not to mention the providing her with rehabilitation and therapy! We must demand these things and accept nothing less than their fulfillment NOW.

In the course of sleuthing this blatant victimization of Terri Schiavo, the professional skills of Juan Schoch, Cheryl F., Pamela H.., Gordon Watts, Nancy K., John S., Sarah L., David Kirkland and so many others both in and out of state (too many to mention) who all know who you are, together, remain the never ending force to bring forward all the truth, to make it easier for the Schindler family to save their daughter Theresa from this heinous effort to intentionally cause her death. It is a malicious death causing effort waged by the likes of Bushnell, Felos, Michael (her adulterous husband), the complicit fiancée Jodi (who has borne at least two of his children), all facilitated with the active assistance of the entire Florida Judiciary and scores of duped public employees. The success of this saving of our society from itself goes to the PUBLIC-AT-LARGE, who have rallied behind this effort to stop tyranny and this death making machine that only serves itself. Without the tireless efforts of all the Terri Supporters and the scores of attorneys across this country who continue to valiantly take on the courts -- to which their very professions lay in the sling as a result of their attack against this tyranny -- much of this would not have been possible to date. Please hear me out. This is not a lefty issue or a righty issue. This is a human rights issue. When we can all just drop our affilliations and do what's best for all, we'll get more done.

What is happening in Florida is that the state is presuming the posture of disposing of unwanted people as an authority. This offends every leaning from left to right and interrupts everyone's constitutionally guaranteed rights to life, liberty and pursuit of happiness.

Both sides of the political coin have everything to lose. While it may be fun to debate and argue on other matters, this one should be an absolute conduit for one and all. No one deserves this kind of treatment.

I have a question. Felos claims people's spirits reach out and touch him, right? Where he is told this or that person wants to be let go? How much more evidence do we need?

Disability Activists Call for Moratorium on Starvation and Dehydration

Disability activists have called for a nationwide moratorium on the dehydration and starvation of people alleged to be in “persistent vegetative state.” This would apply to individuals who do not have an advance directive or durable power of attorney.

The call for a moratorium is a reaction to the newly-published report indicating high levels of brain activity in people thought to be in “minimally conscious state (MCS).” The study, published in the February issue of Neurology, discovered evidence that these individuals may hear and understand much of what is going on around them, but are unable to respond.

The study drew a distinction between MCS and Persistent Vegetative State (PVS), but the distinction is not a reliable one. In a New York Times article, Dr. Joseph Fins mentioned research indicating a 30% misdiagnosis rate of PVS, indicating that nearly a third of persons diagnosed in PVS are actually in “minimally conscious state.”

Fins is chief of the medical ethics division of New York Presbyterian Hospital-Weill Cornell Medical Center.

With the exception of oblique references to Terri Schiavo, current coverage of the study and its implications dance around the most important issues regarding this study. Namely, thousands of people around this country with labels of both MCS and PVS are being starved and dehydrated, often without an advance directive indicating their wishes, or a durable power of attorney appointing a substitute decision-maker they chose for themselves.

“Given the current research regarding brain activity and misdiagnosis, it’s a virtual certainty that countless people have been helpless to prevent their own deaths through starvation and dehydration,” says Stephen Drake, research analyst for Not Dead Yet, a national disability rights group opposed to legalization of assisted suicide and euthanasia. “There’s an analogy to DNA evidence and the death penalty. Here in Illinois, the staggering numbers of innocent and wrongly convicted people on Death Row resulted in a moratorium on the death penalty. Whether you agreed with the death penalty or not, everyone was forced to find ways to make sure no innocent person ended up on Death Row again. The same amount of concern should apply to medically induced deaths, in which the numbers far exceed the number of convicted people executed each year.”

Not Dead Yet is calling for a moratorium on the withholding of feeding tubes from people in PVS and MCS until they can be tested under the same protocol used on individuals in the Neurology study.

State-of-the-art testing for cognitive activity should be a minimum standard to be applied when someone’s death is proposed. Just as the availability of DNA testing and competent counsel are accepted as essential to people being tried in capital cases, the new technical tools to evaluate cognitive activity and potential should be applied to individuals before feeding tubes are withdrawn. Even with this technology, there will probably still be mistakes.

But at least it will be the first step in reducing the number of conscious people dying from hunger and thirst in hospitals and nursing homes, aware of every minute and unable to cry out that they are awake.

By now you have probably heard about a young woman who is threatened with starvation in Florida.

That young woman is my daughter, Terri. In 1990, through circumstances which are shrouded in mystery (and may involve a criminal act by Terri's estranged husband), my daughter was left severely brain-damaged.

But before I go any further, I must put an end to the lies and misinformation that are circulating around the country through the media concerning my daughter's condition.

Contrary to anything you may have heard, Terri is NOT brain dead; Terri is NOT in a coma; she is NOT in a "persistent vegetative state;" nor is she on ANY life-support system.

Terri laughs, Terri cries, she moves, and she makes child-like attempts at speech with her mother and me. Sometimes she will say "Mom" or "Dad" or "yeah" when we ask her a question. When I kiss her hello or goodbye, she looks at me and "puckers up" her lips.

This may not seem like much to you, but it means everything to Terri's mother and me. It tells us she is still here, she still knows us, and with therapy and time she can have some level of recovery.

I know that there are some hard hearted people who believe that due to my daughters condition, she is better off dead. Words cannot describe the pain and anger such sentiments cause us. This is our daughter, our little girl, and even in her disabled condition, she still has the right to life and the right to be loved and cared for by her family.

Why, you may ask, is Terry in danger of death by starvation?

It is a long and outrageous story, but I'll give it to you as briefly as I can.

After the "incident" that left Terri in this condition, her husband Michael Schiavo sued various members of the medical community for money, saying that they did not treat or diagnose her properly at an early stage, and that he needed this money to provide for Terri's therapy and rehabilitation and care.

After lengthy court battles, he finally won upwards of $1.7 million under the guise of caring for our daughter, and then to our horror, he immediately began spending the money on himself and his Playboy lifestyle.

Terri's estranged husband Michael Schiavo has been living with another woman for years, and has two children by her. He is determined to see Terri dead. Why? We believe it's because he gets to keep whatever money is left... and he may have even darker motives than that.

To add insult to all of this injury toward my daughter, Michael Schiavo is still her "legal husband" and therefore is her "guardian." And since they are not legally divorced, he controls whatever health care she will and will not get. We are not even allowed to know if she is getting aspirin.

In 1993 my family initiated litigation against Michael Schiavo solely for the purpose of acquiring medical, physical and neurological assistance for our daughter Terri. The litigation escalated in 1998 when Michael Schiavo petitioned the court to stop Terri from receiving food and water, thereby starving her to death.

In filing this legal action, he retained the services of a high profile euthanasia attorney and the financial backing of powerful euthanasia organizations. He also used Terri's medical rehabilitation money to underwrite much of the legal expenses associated with his effort to starve our daughter to death.

We know that he has spent nearly $500,000 of Terri's money in attorney's fees for just one attorney trying to obtain a court order to have Terri starved to death. The very money that was supposed to be used for Terri's rehabilitation is being used to have her killed.

We very quickly discovered it was impossible for us to compete with the abundance of financial and legal resources the pro-death organizations were providing Micheal Schiavo in their effort to kill Terri. They are pouring time and effort into her starvation because they want to use this case to further the agenda of legalized euthanasia.

My wife and I are not wealthy people. Throughout those years, we did not have any large organizations trying to help rescue our daughter. Consequently, we had to rely on the generosity of attorneys who were willing to offer their legal expertise at no cost or at reduced fees.

The bottom line is that we are in the final weeks or months of our struggle to rescue our daughter from an untimely death by starvation. Death by starvation is very slow, and extremely painful. As you must know, it is against the law to deliberately starve an animal to death. There are members of the Florida court who would not treat a dog the way they plan to treat my daughter.

At this point we must pull out all the stops in our fight to rescue our daughter.

As parents, we are desperate to save our daughter's life. As people who love life, we are determined to deprive the euthanasia advocates of successfully legalizing this form of homicide. We believe that their efforts to kill Terri are designed to set a precedent for the future eradication of defenseless disabled human beings. I was alive when Americans fought the Nazis; I do not want my daughter to meet the same fate of thousands of disabled people in Nazi Germany, and I do not want our country to go down that same dark path.

Friend, though we have never met, I'm asking you for your help. We desperately need your financial assistance to help our family continue the battle to keep our daughter from being starved to death. STATEN ISLAND, N.Y., Feb. 15 (UPI) -- Terri Schiavo is not dying. She has no terminal illness. She is not in a coma. She is not on life-support equipment. She is not alone, but rather has loving parents and siblings ready to care for her for the rest of her life. She has not requested death.
A battle rages over whether she should be starved to death. Schiavo sustained brain injuries and cannot speak or eat normally. Nevertheless, the only tube attached to her is a small, simple, painless feeding tube that provides her nourishment directly to her digestive system. Her legal guardian is her husband, who already has another woman -- by whom he also has children. He wants Terri Schiavo's feeding tube removed. Of course, he could simply allow her to be cared for by her parents and siblings and get on with his life, but he refuses.

I have had two opportunities to visit Terri Schiavo, most recently on the first Sunday of February. I have been able to talk to her, to listen to her struggle to speak, to watch her focus her eyes and smile and attempt to kiss her parents. I have prayed with her, blessed her, and assured her that she has many friends around the country and around the world, who love her and want her to enjoy the same protections we all enjoy, even when we're wounded.

News articles have recently characterized Terri's situation by saying that some want to keep her alive against her husband's wishes. But Terri Schiavo is not dying. What does keeping her alive mean, if not the same thing as keeping you and me alive -- that is, by giving us adequate food, shelter, and care?

Some say that Terri's family should let her go. But this is not a matter of letting her go, because she isn't going anywhere. If, however, she is deprived of nourishment, then she would slowly die in the same way that any of us would slowly die if we were deprived of nourishment. It is called starvation. If the courts permit that to happen, then why should that permission apply only in Terri Schiavo's case? There would be no way to limit it to her case alone. Countless others would follow, and their deaths would be described as letting them die instead of killing them.
Where, indeed, does the state get the authority to starve people? Court decisions permitting this lack all authority, as Pope John Paul II teaches in Section 72 of The Gospel of Life. These decisions cannot be obeyed, because they are not binding on the conscience and are in fact acts of violence.

At the present time, there are two simple things you can do. Educate your neighbors about this situation. A section of the PriestsforLife.org Web site is devoted to educating people about her case.

Second, contact anyone you know in Florida and ask them to encourage Gov. Jeb Bush and members of the Florida Legislature to continue doing everything possible to save Terri Schiavo's life.

Save Terri Schiavo from being murdered

If you can get this information to as many people as possible and have them do the same and so on then we will get a good geometrical progression going on in regards to actions being taken on Terri's behalf. Ping your lists, post to your state locales and send it to via e-mail and otherwise. Spread it out and do take action.

George Felos says that people are nuts who are trying to help this Terri from being murdered. He says that if you put Michael Schiavo in Google that by now you will see that he conspired with Bin Laden, etc. Can we please show Mr. Felos he is the nutcase and that he is helping to aid and abet murder?

Called several numbers on the contact list of people on the Judicial Committee to call to voice displeasure with House Bill 0523 / Senate Bill 0988. I got down to Baxley and his secretary said he didn't know of the HB0523. His secretary told me so. Get on those phones people. She brought it up and said "Oh my". Basically I told her what it was about. I said that the House Bill HB701 was a good bill. Baxley is the one who is the sponsor of it she said. Apparently it is similar to the HB692 that never made it to the floor because of Jim King and his Legacy (legacy of brutality, etc.). Baxley's secretary is going to bring HB0523 to Rep. Baxley's attention. Senator Campbell is the sponsor of the heinous bill in the senate (Senate Bill 0988). I couldn't find one of the sponsors of the House Bill -> Mr. Carlos Lopez-Cantera but Baxley's secretary got me his phone number. Tallahassee: 850-488-4202. District Office: 305-442-6977. Basically Baxley's secretary told me in regards to a question I had about asking a Rep. about who is responsible for a bill being introduced, etc. that most Reps. will tell you who it is, etc. Time to find out people. Make some calls.

I just recently got off the phone with someone (Kelly) in Senator Campbell's office approx 3:13pm. I wanted to find out who he was sponsoring the Senate Bill 0988 (Dead man's statute). When Kelly called me back she relayed to me that he was sponsoring it for the States Attorney's Office. I asked which one as there are various States Attorney's. She said the States Attorney's Office AS-A-WHOLE. This is very telling. The States Attorney's Office has refused to investigate crimes against Terri Schiavo and now they want to let the courts and others get off scott free because of their new bill they want to get passed. This is inexcusable and smacks of corruption to me. They want to make hearsay testimony in court that was accepted in court be valid in determining whether a conflicted guardian through the courts can have someone put to death by asserting false wishes, etc. As long as a corrupt judge accepts the hearsay wishes then they want to make it OK. They also want to get off the hook for not investigating those trying to murder Terri. We cannot let them succeed. She is being denied having her own voice through denial of rehab and therapy and she is still being held hostage by the Hospice of the Florida Suncoast, Inc. who has connections to the Office of Elder Affairs and the Department of Health. Is this why they are letting be held hostage for almost 5 years? and why they have been allowed in the past to make 2 other attempts on her life through dehydration/starvation which is against the laws of this state? They try to make this a right-to-die case but it is simply a right-to-kill case and one that involves criminal intent to murder giving the appearance that it is lawful... their trickery is under color of law. Please act!!!

We have a potential legislative crisis in Florida that affects vulnerable persons. Florida's Evidence Code may soon be modified in such a way that hearsay testimony (of an incapacitated person's oral declarations) from potentially conflicted guardians, beneficiaries or heirs at law could become admissible in a court of law.

Currently, Florida Statute 90.602 provides protection for incapacitated persons by forbidding self-serving hearsay of alleged oral declarations as admissible evidence in court:

(1) No person interested in an action or proceeding against the personal representative, heir at law, assignee, legatee, devisee, or survivor of a deceased person, or against the assignee, committee, or guardian of a mentally incompetent person, shall be examined as a witness regarding any oral communication between the interested person and the person who is deceased or mentally incompetent at the time of the examination.

But some Florida lawmakers are interested in eliminating this particular protection for vulnerable persons by repealing FS-90.602 and incorporating the following measure titled HB-0523. An identical Senate Bill exists under the title S-0988. This would change the evidence code in the following fashion:

13 Section 1. Section 90.602, Florida Statutes, is repealed....

20 (e) Statement by deceased or ill declarant similar to one
21 previously admitted.--If a declarant is unavailable as provided
22 in paragraph (1)(d), a written or oral statement made regarding
23 the same subject matter as another statement made by the
24 declarant that has previously been admitted in evidence.
25 Section 3. This act shall take effect July 1, 2005.

This bill, if passed into law, may serve to eliminate a very important standard of evidence and reduce the rights and protections of incapacitated Floridians yet another notch. Considering the dangers that already exist for Floridians who have been deemed incompetent by the court, this act could effectively remove bars against abuses of the incapacitated person's financial interests and medical treatment desires by the guardian or other interested parties by allowing hearsay to be considered evidence in guardianship proceedings. House Bill 0523 has been pre-filed as of January 25, 2005 and is slated to be heard by the House Judiciary Committee sometime leading up to regular session in March. The anticipated effective date of this act is July 1, 2005.

According to the committee's Council Director, David de la Paz, it is not too late for Floridians to make their displeasure with this bill known. It is important that Floridians, disability advocates, elder care advocates and advocates for medical ethics reform express their deep concerns over any measure or act that would further encroach upon the rights of our most defenseless citizens.

Felos has reportedly received over $550,000, which has elicited charges that he is perpetuating the case for financial gain. According to the last accounting made public, for the period of March, 1998 when he was first hired until September, 2001, Felos was reportedly paid $307,188. Former attorney Deborah Bushnell was paid $49,958 and there were four other attorneys, two presenting Michael Schiavo and two court-appointed attorneys in the matter. According to the last accounting made public, until Sept. 2001, Felos had been paid $307,188 and he's now claiming he received less than $50,000 for the last four years????
